Leave & License और Rent Agreement में क्या अंतर है?

महाराष्ट्र में घर या property किराये पर देते समय Leave & License Agreement और Rent Agreement/Lease शब्द अक्सर एक-दूसरे के लिए इस्तेमाल किए जाते हैं। लेकिन कानूनी रूप से दोनों की प्रकृति अलग हो सकती है।

सबसे पहले यह समझना जरूरी है कि किसी document का नाम ही उसकी कानूनी प्रकृति तय नहीं करता—agreement में लिखी वास्तविक terms और लागू कानून महत्वपूर्ण होते हैं।

🏠 Leave & License Agreement क्या है?

Leave & License में property owner दूसरे व्यक्ति को property का उपयोग करने की permission/licence देता है, agreement में तय शर्तों के अनुसार।

महाराष्ट्र में applicable Leave & License agreements के लिए Maharashtra Rent Control Act, 1999 की Section 55 लिखित और registration की requirement देती है। Registration की जिम्मेदारी landlord पर रखी गई है।

🏡 Rent Agreement / Lease क्या है?

Lease में सामान्यतः property में right to enjoy the property एक निश्चित अवधि के लिए transfer किया जाता है। इसकी कानूनी प्रकृति Leave & License से अलग होती है।

इसलिए किसी document को केवल “Rent Agreement” कह देने से यह जरूरी नहीं कि वह legally lease ही हो।

केवल “11 months” लिखे होने से document automatically Leave & License नहीं बन जाता। Agreement की वास्तविक terms और legal nature देखना जरूरी है।

इसी तरह “Rent Agreement” नाम होने से document automatically lease नहीं बन जाता।

💰 Charges में क्या अंतर है?

Charges agreement की legal nature और terms के अनुसार अलग हो सकते हैं।

Leave & License के लिए Maharashtra Stamp Act में applicable stamp-duty provisions हैं। इसलिए rent, deposit, period और agreement में मौजूद अन्य financial terms को ध्यान में रखना जरूरी है।

Stamp Duty और private service charges अलग चीजें हैं।

📄 कौन सा Agreement चुनना चाहिए?

यह property, duration, intended use और parties के rights/obligations पर निर्भर करता है।
