महाराष्ट्र में Leave & License Agreement Renewal कैसे करें?
महाराष्ट्र में Leave & License Agreement की अवधि समाप्त होने से पहले Owner और Licensee को यह तय करना चाहिए कि agreement को नई अवधि के लिए जारी रखना है या समाप्त करना है। महाराष्ट्र Rent Control Act, 1999 की Section 55 के अनुसार Leave & License/letting agreement लिखित और registered होना चाहिए। (India Code)
🔄 Renewal की प्रक्रिया
1. Existing Agreement की expiry date देखें
सबसे पहले पुराने registered agreement की:
Start Date
End Date
Monthly Licence Fee
Security Deposit
Notice Period
जांच करें।
Agreement की अवधि समाप्त होने के बाद स्थिति को अनदेखा न करें। महाराष्ट्र के एक सरकारी Rent Control decision में expired Leave & License period को महत्वपूर्ण माना गया है। (Rent Control Act Maharashtra)
2. Owner और Licensee की सहमति लें
Renewal से पहले दोनों parties तय करें:
नया rent कितना होगा?
Deposit वही रहेगा या बदलेगा?
नई agreement period कितनी होगी?
Maintenance कौन देगा?
Notice period क्या होगा?
कोई नई condition जोड़नी है या नहीं?
3. Documents और Details Update करें
यदि जानकारी बदल गई है तो नई details तैयार करें:

Flat/House/Shop details
Society/Building details
4. नया Renewal Agreement तैयार करें
Renewal में पुराने agreement की सभी conditions को blindly copy करने के बजाय current rent, deposit, dates और नई terms को verify करें।
उदाहरण:
पुराना agreement:01/09/2025 – 31/07/2026
Renewal:01/08/2026 – 30/06/2027
नई अवधि और financial terms agreement में स्पष्ट होनी चाहिए।
5. Stamp Duty और Registration Charges Check करें
Renewal के लिए लागू current stamp duty और registration charges अलग से check करें। Government charges agreement की अवधि और financial terms पर निर्भर कर सकते हैं।

6. Registration Process पूरा करें
Applicable registration process में agreement submission, payment, identity verification और आवश्यक biometric/e-signature steps शामिल हो सकते हैं।

7. Registered Renewal Copy रखें
Registration पूरा होने के बाद:
Owner को copy रखें
Licensee को copy रखें
Payment/transaction details सुरक्षित रखें
पुराने agreement की copy भी सुरक्षित रखें
⚠️ Agreement Expire हो चुका है तो?
यदि agreement पहले ही expire हो गया है, तो केवल पुराने agreement को continue मानकर चलने के बजाय current legal and registration requirements verify करें और Owner/Licensee की स्थिति के अनुसार नया agreement/renewal तैयार करें।
