Leave & License Agreement Registration की पूरी प्रक्रिया — महाराष्ट्र

महाराष्ट्र में Leave & License Agreement बनाते समय केवल agreement तैयार करना ही पर्याप्त नहीं है। महाराष्ट्र Rent Control Act, 1999 की Section 55 के अनुसार Leave & License या letting से संबंधित agreement लिखित और registered होना चाहिए, और registration कराने की जिम्मेदारी landlord पर रखी गई है। (India Code)

1. Owner और Licensee की जानकारी तैयार करें

सबसे पहले दोनों parties की सही जानकारी तैयार करें:

Owner / Licensor

पूरा नाम
पहचान और address details
Mobile number

Licensee

पूरा नाम
पहचान और address details
Mobile number

नाम और अन्य details documents के अनुसार सही रखें।

2. Property Details तैयार करें

Agreement में property की पूरी जानकारी दर्ज की जाती है:

Flat / House / Shop number
Building / Society name
पूरा address
Area / locality
City और District
Residential या Commercial use

3. Rent और Deposit तय करें

Agreement में financial terms स्पष्ट करें:

Monthly Rent / Licence Fee
Security Deposit
Agreement period
Start date
Notice period
Maintenance और utility responsibilities

इन details के आधार पर applicable stamp-duty calculation की जाती है।

4. Agreement Draft तैयार करें

Owner और Licensee की सहमति के अनुसार agreement में terms & conditions लिखी जाती हैं।

इसमें सामान्यतः शामिल होते हैं:

Rent payment terms
Deposit terms
Property use
Maintenance
Electricity / utilities
Notice period
Termination conditions

5. Stamp Duty और Registration Fee की Calculation करें

Leave & License Agreement के लिए लागू stamp duty और registration fee की गणना current Maharashtra rules के अनुसार करें।

9. Registered Agreement प्राप्त करें
